These Terms and Conditions ("Terms") govern your access to and use of Aero Rush: Skybound (the "App"), the website aerorushskybound.com (the "Website"), and any related pages, features, content, or services that link to these Terms (collectively, the "Service").
The Service is operated by AERO RUSH SKYBOUND LTD, referred to in these Terms as "we," "us," or "our."
Please read these Terms carefully before accessing or using the Service. By downloading, installing, accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
1. About the Service
Aero Rush: Skybound is a one-thumb arcade flight shooter for iPhone: you drag anywhere on the screen to steer a red 1930s racer up through four scrolling arenas while your guns fire automatically, fighting enemy formations and bosses, charging the Rush dash, and spending the coins and rank experience you earn on planes, upgrades, and arenas in the hangar. The Website presents the game and provides support information.
The Service may allow users to browse game information, view screenshots, contact support, and download the App through the Apple App Store. The exact features of the Service may change over time.
2. Entertainment Only — No Real-Money Gambling
The Service is a game and does not provide real-money gambling of any kind. The Service does not allow users to place bets or wagers using real money, deposit money for gameplay, withdraw money, purchase gambling credits, receive cash winnings or monetary prizes, exchange game results for money or property, or participate in any form of real-money gambling. Nothing available through the Service constitutes an offer to participate in gambling, betting, wagering, lotteries, or any other activity involving the risk of money or property.
3. In-Game Coins and Progress
The App includes coins, rank experience, and other progression values as part of its simulated gameplay. Unless we expressly state otherwise in an updated version of these Terms:
- coins and progression values are earned only through gameplay;
- they have no monetary value;
- they cannot be purchased with real money — the App contains no in-app purchases;
- they cannot be sold, redeemed, withdrawn, transferred, or exchanged for money, goods, or anything of value;
- they do not constitute property and do not create any entitlement against AERO RUSH SKYBOUND LTD; and
- they are stored locally on your device and may be lost if the App is deleted or its data is cleared or reset.
4. Gameplay Results
The App is an entertainment experience. Gameplay outcomes have no monetary consequence, and users cannot win money, prizes, property, or anything redeemable for monetary value through gameplay. Outcomes depend on skill and chance within the game's design; we do not guarantee any particular result, score, drop, or reward.
5. Age and Legal Capacity
The Service is a general-audience game and is not directed to children. By accessing or using the Service, you represent and warrant that you have the legal capacity to agree to these Terms and that your use of the Service is lawful in your jurisdiction. If you are a minor and your jurisdiction requires consent from a parent or guardian for use of services of this kind, you must have that consent.
6. Local Laws and Availability
You are responsible for ensuring that your access to and use of the Service complies with the laws applicable to you. We do not represent or warrant that the Service is appropriate, permitted, or legally available in every country, state, province, or territory. We may, at our discretion and where legally permitted, restrict availability, limit functionality, or modify the Service to comply with applicable legal or platform requirements.
7. User Accounts
The Service does not require or offer user accounts. If we introduce account functionality in a future version, additional terms may apply and will be presented before use.
8. License to Use the Service
Subject to your compliance with these Terms, AERO RUSH SKYBOUND LTD grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for lawful, personal, and non-commercial entertainment purposes. This license does not transfer ownership of the Service or any content to you. Except where expressly permitted by applicable law, you may not copy, reproduce, redistribute, sell, sublicense, commercially exploit, modify, or create unauthorized derivative works of the Service; reverse engineer, decompile, or disassemble the Service; attempt to extract source code; circumvent technical protection measures or security mechanisms; or access restricted portions of the Service. All rights not expressly granted to you are reserved.
9. Acceptable Use
You agree to use the Service lawfully and responsibly. You must not use the Service to violate applicable law; violate the rights of another person; distribute malware, viruses, or malicious code; gain unauthorized access to systems; attack or disrupt our infrastructure; automate interactions in a manner that interferes with the Service; bypass access restrictions; manipulate rankings or statistics; interfere with other users; impersonate another person; exploit bugs or vulnerabilities; infringe intellectual-property rights; distribute unlawful or harmful material; or use the Service for fraudulent purposes.
10. Automated Access and Scraping
Unless we provide written permission, you may not use automated systems to access the Service in a manner that creates an unreasonable load on our infrastructure, bypasses rate limits or technical restrictions, copies substantial portions of our content, or interferes with normal operation. Search engines may index publicly available portions of the Website in accordance with generally accepted web-indexing practices unless otherwise restricted.
11. Intellectual Property
The Service includes intellectual property owned by or licensed to AERO RUSH SKYBOUND LTD, including software, source code, website and application design, user interfaces, text, graphics, illustrations, logos, icons, trademarks, branding, audiovisual materials, and the selection and arrangement of content. These materials are protected by copyright, trademark, trade-secret, and other intellectual-property laws. You may not use our intellectual property except as permitted by these Terms or with our prior written authorization.
Third-party names, logos, and trademarks — including Apple and App Store marks — remain the property of their respective owners. If you believe content available through the Service infringes your intellectual-property rights, please contact support@aerorushskybound.com with sufficient information for us to investigate the matter.
12. Third-Party Platforms and Links
The Service may link to external platforms, including the Apple App Store. External links are provided for convenience. We do not control or endorse external websites, and visiting them may subject you to their own terms, privacy policies, and conditions. Third parties operate independently from AERO RUSH SKYBOUND LTD, and to the maximum extent permitted by applicable law we are not responsible for their terms, privacy practices, content, availability, security, or technical problems.
13. Advertising
The Service does not display advertisements and contains no advertising technologies.
14. User Feedback
You may voluntarily submit ideas, suggestions, comments, bug reports, recommendations, or other feedback relating to the Service ("Feedback"). To the extent permitted by law, you grant AERO RUSH SKYBOUND LTD a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, reproduce, modify, and incorporate Feedback for the purpose of operating, developing, and improving the Service. This provision does not transfer ownership of personal information contained in your communications, which remains subject to our Privacy Policy.
15. Privacy
Our collection and processing of personal information in connection with the Service are described in our Privacy Policy, which forms part of the overall terms governing your use of the Service.
16. Data Deletion
The Service does not require user accounts, so there is no account to delete. Game progress and settings are stored only on your device and can be erased by resetting progress from the App's Settings or by deleting the App. If you have shared personal information with us (for example through a support email), you may request deletion by contacting support@aerorushskybound.com.
17. Service Availability and Changes
We aim to maintain the Service but do not guarantee continuous availability. The Service may become temporarily or permanently unavailable because of maintenance, technical errors, hosting-provider outages, security incidents, legal requirements, or force majeure events. We may modify, suspend, restrict, or discontinue all or any portion of the Service at any time where permitted by applicable law. Content and features may be added, removed, replaced, updated, or discontinued, and your use of the Service does not give you a permanent right to access any particular game, feature, or piece of content.
18. Software Updates
We may release updates to the App, including security updates, bug fixes, functionality changes, performance improvements, and compatibility updates. Certain updates may be required for continued use. Failure to install required updates may cause portions of the App to stop functioning correctly.
19. Application Store Terms
If you download the App through a third-party application marketplace, including the Apple App Store, your use of the application may also be subject to that platform's terms. To the extent these Terms conflict with mandatory terms imposed by the relevant application store, the mandatory application-store terms will apply to the extent of the conflict.
20. Apple App Store Users
The following provisions apply if the App is downloaded through Apple's App Store. You acknowledge that these Terms are between you and AERO RUSH SKYBOUND LTD, not Apple Inc. ("Apple"). AERO RUSH SKYBOUND LTD, and not Apple, is solely responsible for the application and its content, subject to applicable law. The license granted to you for the application is limited to a non-transferable license to use the application on Apple-branded products that you own or control, subject to the applicable Apple Media Services Terms and any permitted family-sharing or volume-purchasing arrangements. To the extent required under Apple's applicable terms: Apple has no obligation to provide maintenance or support services for the application; AERO RUSH SKYBOUND LTD, rather than Apple, is responsible for addressing claims relating to the application and for investigating valid intellectual-property infringement claims relating to it; and Apple and its subsidiaries are intended third-party beneficiaries of the portions of these Terms applicable to App Store distribution and may enforce those provisions where permitted. Nothing in these Terms limits rights that cannot lawfully be limited under Apple's applicable terms or applicable consumer law.
21. No Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the extent legally permitted, AERO RUSH SKYBOUND LTD disclaims warranties and representations of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, and uninterrupted operation. We do not warrant that the Service will always be available, will be error-free, will function on every device, or will meet every user's expectations. Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.
22. Technical Malfunctions
The App may occasionally experience freezes, crashes, display errors, interrupted sessions, or other technical errors. Because gameplay does not involve real money or redeemable value, a technical malfunction does not create an entitlement to payment, compensation, credits, prizes, or other monetary value. We may reset, correct, remove, or discontinue technically defective content. Game progress affected by a malfunction or device loss cannot be restored, because it is stored only on your device.
23. Limitation of Liability
To the maximum extent permitted by applicable law, AERO RUSH SKYBOUND LTD, its affiliates, directors, officers, employees, contractors, representatives, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service, including loss of use, loss of data, interruption of service, device problems, or inability to access particular features. Because the Service is provided free of charge and involves no redeemable value, the total aggregate liability of AERO RUSH SKYBOUND LTD arising from or relating to the Service or these Terms will not exceed the minimum liability permitted under applicable law. Where applicable law does not permit a particular exclusion or limitation of liability, that exclusion or limitation applies only to the maximum extent permitted by law.
24. Consumer Rights
Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, restricted, or modified under applicable consumer-protection law. If you are entitled to mandatory consumer protections in your jurisdiction, those protections continue to apply notwithstanding anything in these Terms.
25. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless AERO RUSH SKYBOUND LTD and its affiliates, officers, directors, employees, contractors, licensors, and representatives from claims, liabilities, losses, damages, costs, and expenses arising from your unlawful use of the Service, your material violation of these Terms, your infringement of another person's rights, or malicious, fraudulent, or abusive activity conducted by you through the Service. This section does not require a consumer to indemnify us where doing so would be prohibited or unenforceable under applicable law.
26. Suspension and Termination
We may suspend, restrict, or terminate your access to the Service where reasonably necessary because of violation of these Terms, suspected fraud, abusive behavior, security threats, unlawful activity, legal requirements, or discontinuation of the Service. You may stop using the Service at any time, and if you have installed the App, you may uninstall it from your device. Upon termination of your right to use the Service, your license ends and provisions intended by their nature to survive termination will remain effective, including provisions relating to intellectual property, disclaimers, liability, and dispute resolution.
27. Changes to These Terms
We may update these Terms periodically because of changes to the Service, new features, legal requirements, application-store requirements, security concerns, or changes to our business operations. When we update these Terms, we will revise the "Last Updated" date. Where required by law, we will provide additional notice before material changes become effective, and if your consent is legally required for a change, we will request it. Your continued use of the Service following legally effective changes constitutes acceptance of the updated Terms to the extent permitted by applicable law.
28. Dispute Resolution
Before commencing formal legal proceedings, you and AERO RUSH SKYBOUND LTD are encouraged to attempt to resolve any dispute informally. You may contact us at support@aerorushskybound.com with enough information for us to understand and investigate the issue. Nothing in this section deprives consumers of protections or forums that cannot legally be waived under applicable law.
29. Force Majeure
To the extent permitted by law, we will not be responsible for failure or delay in performing obligations caused by circumstances outside our reasonable control, including natural disasters, war, civil unrest, government action, internet or electricity outages, telecommunications failures, hosting-provider failures, third-party infrastructure failures, cyberattacks, epidemics, labor disputes, or similar events.
30. General Provisions
- Severability. If any provision is unlawful, invalid, or unenforceable, it will be interpreted or modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
- No waiver. Our failure to exercise or enforce a right does not constitute a waiver of that right.
- Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where applicable law gives you a non-waivable right to do so. We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, financing, or sale of assets, subject to applicable law.
- No partnership. Nothing in these Terms creates a partnership, joint venture, employment, fiduciary, or agency relationship between you and AERO RUSH SKYBOUND LTD.
- Third-party beneficiaries. Except for application-store providers as provided above, these Terms do not create enforceable rights for third parties.
- Electronic communications. When you communicate with us electronically, you consent to receiving legally permitted communications electronically.
- Headings. Section headings are for convenience only and do not limit or alter the meaning of the provisions.
- Entire agreement. These Terms, together with our Privacy Policy and any additional terms expressly presented for a particular feature, constitute the agreement between you and AERO RUSH SKYBOUND LTD concerning your use of the Service.
- Language. These Terms are provided in English, which is the controlling version to the extent permitted by applicable law.
